A'af,

This has to be resolved now indeed! You have taken offense when people pressure you and reassured us many times that you will make everything right. Months ago you said that you needed more time to accumulate funds and the people that ordered from you have been very patient. You HAVE repayed most members involved, and it would be silly to stop now, being so close to resolving this.

We have allowed you to open other threads selling parts with the idea that funds from these buys would help you repay people here. We will not be able to allow you to continue selling anything if the profits aren't being used to repay people who have trusted you. This needs to be resolved immediately. I wrote you only a week ago about this and got no response. We need to hear what your specific timetable is now!

Here a sum up of my email communication with A'af very recently (the exact words he used in "quotation marks"):

I contacted A'af about my refund a week ago (since month the first time I talked to him again).
Annoyed about the lack of communication and updates I asked where the problem is.
Within a quarter of an hour A'af responded that he is "ashamed" and that he should have emailed earlier.

He insured me once again that he "not want run from this".
Here a couple of other quotes from his email:
"Yes 9 month is a long time, but how can i say, i still search the best way to finished this, really".
"I'll try very hard to solve all this mess, but the problems is not simple as somebody see it".
"I need your patient and understanding and thanks a lots for anykind of support you and others gave me".

The problem is that his "distributor run away" from the problems (they did not refund anything to him) and he even had to hire a lawyer to take care if the issue.
The refunds which have been given up to now have been paid out of his pocket which, how he phrased it, "hurts very bad to me and my family".
He further said he lost about $7k with this case and now he run out of money to also refund those with the biggest shares in this groupbuy (a few others and me).

He offered me to PayPal a partial refund of $200 which seems all he can afford at the moment.
I declined (for now) because I do not use online payments anymore (and overseas wire transfer fees are high, in particular in relation to smaller amounts) and because I don`t want to embarrass him and his family in severe financial difficulty.

I don`t know how much this sales on DIY-Audio.com add to A'af`s income (BTW, he mentioned already some time ago that the sales are decreasing, very probably due to this JFET disaster) but I could imagine that if they`re to be stopped completely that this doesn`t help our refunds in any way.

I`d agree about a specific timetable but given the current situation I fear this is impossible for A'af.

What is possible however and really much needed is more communication from A'af.
I understand that A'af fears to show up here without being able to present the final solution or at least any positive progress but as unpleasant it is for both camps, IMO better bad news than no news.

So please A'af, don`t be afraid and come back here. The worst thing You could do is to stop communication at this point.

So this is the current list

luvdunhill
cocolino
tony
RKH
jekyll
jacco vermeulen
markus
TLJ
PHansen
MarkLai

I would suggest to A'af that he pay off any that he owes small amounts to as it makes the list smaller with less pain.

Possibly we should post how much is owed to each?

As I said before, A'af has done a good job taking care of most, but the job needs to be finished. I believe that his efforts are sincere, but this won't go away until the final member is satisfied...

While we understand that A'af didn't intend to defraud people, and seemed to be paying everyone back. He seems to have lost interest at this point.

I am very disappointed in this. He has paid back the majority of those that ordered, BUT it puzzles me as to why he seems to have stopped. Obviously this was a huge financial blow to him but the remaining members are no less deserving of payback that others and the amount is much less than he has already paid. We have allowed him to continue to sell here in the hope that he could raise the remaining money. It appears that he really isn't selling enough to do this.

At this point, unless he offers some explanation he will have to leave this place and not return.

All I am asking is that he explain his plan and begin again to make some effort. He has insisted- almost in annoyance, that he would pay everyone. If he couldn't , then he should have distributed the losses evenly- everyone should have gotten something back- even if not the whole amount.

As I said, he cannot continue to participate here if I don't get some sort of communication in the near future.

I did not get a full refund but around 85%.
My loss was postage both ways, fees, and currency variation.
Then he tells us the postage back was of no value.
I should have kept them for another use.

a'af

To repeat what I have said before, communication is the key here. You didn't answer my e-mails and I then became concerned.

It has been months and no messages from you. You could have written what you did just now, and the unpaid people would at least know something.

I want to leave this thread open so that we can continue to keep in touch, and so that you can report every month on any progress or no progress. The intention isn't to embarass you, but to keep everyone informed. Will you agree to that?

Mark

Very agreed...

i already reply to your mail on 19th august. will try to report, but the progress is too slow and actually nothing really important to be report.

the progress from my last report are:

luvdunhill
RKH
MarkLai

already got refund

and i found missed psroczka from my list to be refunded.

The documents studied by team lawyer in middle of july and the documents go to court in the end of august and until now nothing called from the court for the case, instead the team try to persuasive the company (seller)

For my personal report, my mum got sick cause head trauma, being 3 weeks more in intensive care unit (ICU) for nothing, she died on 18th september :bawling: :bawling: :bawling:

all the best,
a'af
