I'm pretty sure copyright laws don't apply to people not trying to profit from cloning. The only time you'll get into trouble is if you copy something and then try and pass it off as your own and sell it for profit. As long as it's for personal use I'm pretty sure there isn't anything that can be done about it. And chances of you getting ahold of someone at goldmund that could give you consent are slim anyways.

arguably though this community belongs to the research use excemption. any patented innovation can be reproduced for the purposes to ascertain if the apparatus provides the claimed capabilities or if there are ways around the protected innovation. this is especially hard to argue against when when there us no for profit motive.

i for one participate in this discussion only to ascertain and learn about the capabilities and not with a profit motive. the supreme court has upheld this use and i for one cant see how an intellectual discussion infringes ip law for either patent or copyright.

the argument that the forum owners profits doesnt jive, the digital millenium copyright act in the usa provides safe harbor for service providers as long as they remove copyrighted content once notified. so i dont think this is something the forum itself must police until the copyrightn owners asserts it.




Actually IP law does allow the owner to prevent you from doing your own DIY kit. ie - they can sue you for a license fee if they are feeling particularly protective or have the materials that you build using their IP confiscated.

Similarly, it's the owner's right to sue you for damages should you release their IP to the public; it's why nearly every document out there includes the language "Reproduction in whole, or in part, is prohibited without written consent"

Also, there is a party here that could derive some financial gain from this information being on the site; diyaudio itself.

If Goldmund were to find this thread and they disapproved of it's content (for instance, if they saw that people were saying that their amp design was 'common and hardly worthy of the outrageous price tag', they could [quite justifiably] demand that diyaudio delete the thread and go after the people that made use of the information contained here (not that it's likely as it would be cost prohibitive).

If they did that, the onus would be on the defendant to prove that the amplifier designs were built upon on 'prior art' [that was already in the public domain].

They don't even need to have a registered copyright on the schematic; just a copyright on the documentation that produces it. Laws prohibiting technological reverse-engineering protect them from someone just tracing the PCBs and generating a schematic that way.

Copyright/IP law applies to you whether you support it or not. :)

I don't share files until we are not totaly agree if are correct all files .....:)

So what you are saying is that you can copy anything as long as you sell it at a loss. Therefor I can copy the latest movie onto a CD make a million copies and sell only the CD (medium) not the movie. That will be totally fine because all we want to establish is that the movie is of good quality, we don't really care about the story.

I guess it happens in China and India and counterfeit parts should therefor also be okay to use because they are sold for less than the original.

I am sure everything would be fine if one has a consent from the original owner.

i think both us and international law is quite specific on what constitutes copyright material;

"The types of work which are subject to copyright has been expanded over time. Initially only covering books, copyright law was revised in the 19th century to include maps, charts, engravings, prints, musical compositions, dramatic works, photographs, paintings, drawings and sculptures. In the 20th century copyright was expanded to cover motion pictures, computer programs, sound recordings, choreography and architectural works."

the analog of circuit diagrams and music and books doesnt quite compare since copyright law doesnt extend to electronic circuits. books, movies and songs are covered by copyright law since they are the defined protected classes: dramatic works and sound recordings.

and if i didnt say this explicitly, you cant copy copyrighted content with the copyright holders permission. not even if its not for profit.

habing said that: the circuits we describe in here is neither motion pictures, musical compositions, choreography, dramatic works etc. circuits would be protected by patent law rather than copyright law and for this community and this discussion the research excemption should apply. now, if anyone puts the slightest amount of profit into any of these discussions then the research excemption ceases to apply.

Enough with the nonsense. Goldmund doesn't have a single patent on any circuit, or any design that they ever built. Anyone and everyone can copy this circuit, build it, and sell it even for profit. You cannot associate their official logo/name with it, other than that, clone away! Some of the stuff in previous threads is plain ludicrous and actually quite funny to read.

bigpanda, can you please organize the group buy? Also, will the boards have Electroless Nickle surface finish? I'm not sure how you want to handle this. DIYAUDIO members who are interested, can you please PM bigpanda, or post here on the forum with your order?

Alex, has not provided the files which would show the "ground plane", on the component side of the PCB. So if there are enough interested members who want the ground plane, maybe we can all kindly ask Alex to provide this file. Otherwise, I say we go ahead without it. The amplifier will perform correctly either way.

Alex, can you please post, or send the printable .pdf files to bigpanda. The final main circuit PCB layout from post #549 and the smaller protection circuit layout?

We will need 1 pair of each board to complete this project. I can be the first one to be added to bigpanda's group buy list. I will take 2 pairs of each board. Total of 4 main circuit PCBs and 4 protection circuit PCBs.

NOTE 1: Please remember, T6 on this PCB is connected incorrectly. When building the amplifier, please follow my original schematic on page one. To correct this problem, T6 will have to be rotated 180 degrees. The correct connection is as follows: T6's (BC182B) Emitter (leg 3) and Base (leg 2) are to be shorted. The Cathode of the 6V Zener diode should be connected to T6's Collector (leg 1).

NOTE 2: D2, D5, D4, and D3 are all connected incorrectly. Please follow my original schematic on page one when building this amplifier to see their correct orientation. To correct this problem, simply reverse the orientation of D2, D5, D4, and D3.

Other than that, this layout and circuit is ready for prime time! The PCB can be etched as is in post #549, so long as these corrections are made while building.

DIY cloners would never be Goldmund buyers I would guess. I can't imagine a Patek adorned wrist and a Weller iron. Or the copper etchant spilling on a Polo T-Shirt. Probably the posh Swiss company does not lose potential customers nor sleep from the guys here I would suppose. IMHO of course.

Nagys, can you please measure the voltage, on the real amp, across the 20k resistor at the collector of the CCS? This way we will know the exact bias current the LTP should have, since simulation is doing a bad job for us here. It would also help others use a reasonable substitution who can't find the BC128B's.

Well I meant schematics and what not.....obviously it's a bit different for media. I guess what I was really talking about were patents. Copyright laws don't really apply to schematics and circuit designs.
