I notice that the easiest way to get Aleph X PCBs at the moment appears to be from a certain well known auction site. From a possessive man's name_audio specifically. These are cheaper than the kk-pcb ones, which I gather are ok with the ip owner and community.
Logic might suggest that so long as the PCBs I am considering are priced less than that of a known accepted source, I would not be supporting an illicit profit venture. One point of this post is to make sure that if I use these red boards, HAL will not become angry, and when/if I finish the build and post pics the community will not cast me down. The other point is to see if anyone knows of a working build using the red boards in question. After all, price and ease of acquisition is not so important if they really only support the construction of a smoke generator...

look at the rest of the pcb that ebay seller lists, mostly all "referenced" to some one elses hard work or patents.

Indeed, that is the PCB. I was refraining from linking it so as not to drive business to "jim" if he is considered to be unreasonably profiting from Nelson's design. Maybe we can get a deeper discussion with the specific PCB pointed out. The question is, if jim's PCBs are sold for less than the kk PCBs, can we say jim is profiting unreasonably? Somewhat tangential, but it looks like jim's PCBs are mostly if not all designs I've seen from the DIY community, the Krell KSA100, several Pass amps, the 3xLM3886.
Is the problem that his purpose is to make any profit? What if I take gerber files for one of these designs to a prototype shop? They are certainly going to make a profit off of the boards. If I just want to justify buying the red boards, I could say that jim just saved me the trouble of rounding up gerber files and taking them to a PCB shop myself, plus his price is well under half of what that would cost me.
I don't just want to justify though. Especially given Nelson's very highly appreciated willingness to help the diy community. What I'd like to figure out is whether there is fundamentally anything different with kk using the diy design, having boards built and selling them to people, and jim doing the same thing. Can we even answer this question without knowing how much it cost each of them to produce the boards, and hence how much gain they each make per sale? Yes, we might term jim's gain "profit" and kk's gain "covering his time and effort", but does that really matter? Maybe it does matter, maybe the whole and only point that matters here is the motive of the seller, regardless of if one were sold for $5 and one for $500.
Round and round my head goes. Enough for tonight. Any thoughts are appreciated.

I feel much the same way as to the Asian rip-offs. That's why I waited to get into digital power amps. Now there is a company in California making Class D modules and they are of much higher quality then the Asian stuff. They are also priced in line as well.

I think the motive matters. If people are running a business selling others people property without their consent, it's wrong. Price is a non factor in my opinion. If a person gets permission from to use Nelson's designs from Nelson then that's different.

I still have at least a couple of the original X boards that I'd let you have for free, just PM me with your address to send em to... can't send em till Wednesday though. I repeat this sort of statement fairly often. People are welcome
to use the intellectual property that I publish on a not-for-profit
basis. This means that the effort is for the benefit of the
community of DIYers, and if money is left over from group-buys

As far as I can see, DIYZONE operates for profit, however slim,
and seems to make a claim that they have been granted
permission by me to use my name and intellectual property.
They have not been granted such permission, and I am given
to understand that they have made additional statements
which are not necessarily flattering to me or my organization,
and has registered some of my trademarks in Taiwan. I do not
read the language, so I only know what people tell me. In any
case, I have left it to the discretion of my distributor in Taiwan to
take legal action as he sees fit.
I am doing too well economically for this to really impact me
personally, but I think it creates damage to the overall DIY
community as it makes other designers more reluctant to
share information. In this regard, DIYZONE does a general
disservice. It's too bad, because I am remarkably easy to
get along with, and it doesn't take all that much for people
to get what they want legitimately.
