If the LPF is set at 40 Hz. then the -3dB mark for 20Hz. can be correct as 40Hz. is the reference point. The fact that's it's already 6-10 dB down at the 40Hz. point doesn't factor into the equation.

It's possible that they've EQ'd it so it really does have a -3dB point of 20Hz.
You'll just find that you only have to tickle it to hit the limiters down there, though.
All this said, it doesn't look any worse than the myriad of products doing similar.
