Ask Richard Kulavik of AKM directly, he always have been very helpful. I spoke to him on several occasions at some other place.

They found a problem when its overloaded and its in process for a fix. No ETA yet per AKM:
"The AK5397 was just beginning to sample when an issue was discovered with modulator instability triggered by over-range input signals. The schedule for the next ES version is TBD."

They found a problem when its overloaded and its in process for a fix. No ETA yet per AKM

Did I ask this question already --- what does BenchMark (newest model) use in their ADC and DAC models?

The Benchmark uses the AK5394A Benchmark ADC1 USB A/D converter | Stereophile.com . Execution similar to the EMU 1212M or 1616M, Better opamps however.
The AK5397 is not pin compatible (Its a QFN package) and has more features. It will work up to 768 KHz sample rates.
