I have been looking into building a crossover that has phase that is the same for all frequencies. I considered the Linkwitz-Riley activer filter (2-way, 24dB/oct) but recently i read a post that says it is phase coherent at the x-over frequency and not linear phase. If i have it right it means that the phase will differ at some frequencies and not be "in phase" the whole time. If so which active filters can you use for linear phase?

For active X-over look at filtercad from www.linear.com
There you can look at phase response, delay, frequency sweep, and pulseresponse for different types of filters.

What's wrong with L-R filters?
If you haven't tried them, I suggest you do. And they work great in a bi-amp setup.

There are no such things as linear phase filters, if they are analogue but if you make them digital, then you can make them linear (constant delay). Filters are a complicated subject but am I right?
