Question Emulated Games on PC

The pirate in me (arrr, hello) says go ahead anyhow but I feel like asking:

As far as you know, what is the deal with licencing on old video games like? I sure don't recall any EULA when I had my Nintendo Entertainment System... Is there one implied still since the stuff is way, way, WAY out of production? Since Sega no longer sells the Genesis, is it still unlawful to use (not sell or distribute, don't ask don't tell ) the games' code in a PC software emulator?
