You should be able to tell if they are in or out of phase by ear. Play a mono signal, and if it's out of phase, it will sound like it's outside your head. As for absolute phase, that's trickier, and maybe not important. On loudspeakers it's usually safe to connect a small DC voltage (like a single 1.5V cell) and see which way the cone moves. With headphones, you'd need to be able to see the diaphragm (which often isn't possible without disassembling the headphones). So, maybe it's safer to just guess based on the colour of the wires, or open up the 'phones and see how the terminals are marked.

Or, use a microphone connected to a real or software oscilloscope, and play a repetitive positive-going test pulse signal through the headphones. Compare them with other headphones in case the phase is inverted somewhere in the playback and capture signal paths.
