Where did you get it? I bought some TDA2040 ICs off ebay and one came with a supply rail on the output. It was put into a known good circuit to test and was swapped with a good one to be sure it wasn't me screwing something up. I had fun blowing up the rest of the working ones by turning the signal to clipping and shorting the outputs. I don't think these fakes even have proper short circuit protection working. I now buy them through DigiKey and have been flawless.
